In the initial stage of the hearing, Sun Yang was asked why he did not cooperate with the test. He said that the main reason was that the other party did not produce a convincing certificate, so he questioned the other party’s testing qualifications.

“All previous agencies to check, their doping testers can produce valid documents and authorization, but this time not,” Sun Yang said.

Sun Yang also said that he had asked at the time to wait for the inspectors to return to bring back valid documents, or to replace qualified personnel to check, but was rejected by the other party.

For the key issue of testing personnel qualifications, WADA’s first witness, Stewart, refuted that the two assistants did not have to provide proof of identity as long as the main inspector had a certificate of authorization.

On the same day, the International Doping Control Management Company (IDTM) is responsible for the specific implementation of the inspection work. The second witness, Turdo, responded, “According to the IDTM rules of work, there is no mandatory requirement for the inspector to provide the agency’s authorization letter during the process of detecting the athlete.”

IDTM project manager Boppa communicated with the on-site doping control officer on the phone and gave instructions based on real-time conditions. When he appeared as a witness, he said that the three staff members who appeared in Hangzhou that night were assigned by IDTM. The information of the three people existed in the institutional system and received relevant training.

“The Doping Control Officer told me that Sun Yang and his companions suggested taking away blood samples. I can hardly imagine athletes like Sun Yang, in order to preserve blood, would damage the samples that have been sealed,” Popa said.

In response to the violent smashing of bloody containers, Sun Yang said that he had not touched the sample bottles. He recalled that it was the security guard who smashed the blood, and that he was only lighting, and the whole process was carried out under the watchful eye of the prosecutor.

Sun Yang claimed that he initially cooperated with the inspection, but since he had doubts about the qualification of the blood inspector, after consulting doctors and experts, he decided to take the relevant rejection action. “Let the three unqualified people take it away. Another point of disagreement is that according to the description of the Doping Control Officer, the inspection scene that night was very confusing. However, Sun Yang’s lawyer pointed out that through the surveillance video, the people present at the time were very calm and there was no fierce scene.

At the scene, the jury once again raised the fact that Sun Yang was punished for taking illicit drugs in 2014. According to the schedule of the International Sports Arbitration Court, Sun Yang’s hearing will begin at 4 pm on November 15th, Beijing time, and will end at 3:30 am on November 16th. The whole journey lasts for nearly 12 hours. Three breaks. During the period, Sun Yang, representatives of the World Anti-Doping Agency and related party witnesses will speak.

But on the day of the hearing, the International Sports Arbitration Court will not immediately announce any decision, but will choose to pronounce it on time, and it may not be announced until early next year.

The “rejection” incident was first publicized in January of this year, when the “Sunday Times” reported that on September 4, 2018, Sun Yang had a conflict with the stimulant tester and may face a life ban.

Afterwards, Sun Yang issued a statement on the matter, claiming that the article was false and that there were multiple violations of the IDTM staff responsible for the flight drug test, including three blood test officers and urine inspectors. The person is unable to provide the authorization file required for the inspection.

The China Swimming Association reported that the report was inaccurate and disclosed the description of the case by the FINA Anti-Doping Committee. At the end of 2018, the FINA held a 13-hour hearing on the matter, “identifying that Sun Yang did not violate the case. The behavior of the World Anti-Doping Ordinance.”

But then, the World Anti-Doping Agency still appealed to the International Sports Arbitration Court on the case of Sun Yang’s refusal. The hearing was originally planned to be held in September this year, and was eventually postponed until November, while publicly hearing Sun Yang’s wishes.

According to the previous World Anti-Doping Agency lawsuit, Sun Yang refused to submit a sample of doping test and asked him to accept a minimum of two years and a maximum of eight years.
