According to the data of the Supreme People’s Procuratorate Report, from January 2018 to October 2019, procuratorial organs across the country approved a total of 80,600 cases of arrest and infringement of minors, and prosecuted 10,700 people.

The number of arrests and prosecutions for the whole year of 2018 increased by 18.39% and 6.82% year-on-year respectively; the number of arrests and prosecutions for the first 10 months of 2019 increased by 22.95% and 28.63% year-on-year respectively.

In April 2018, Xiaoshan District, Hangzhou formulated the Opinions on Establishing a Compulsory Reporting System for Cases of Infringement of Minors, requiring medical and educational institution personnel to discover that minors have been or are suspected of being raped, indecent, abused, abandoned, When violent injury or work injury, fire, falling, drowning, poisoning, suicide and other abnormal injuries or deaths should be reported to the public security organs in a timely manner and records should be kept.

Lack of special child abuse regulations

Once the mandatory reporting system begins, the corresponding judicial procedures must be synchronized. But there is no clear set of child abuse crimes in China.

Related to this are crimes of ill-treatment, insults, intentional harm, and provocation.

The object of the crime of provocation is the public order. Among them, the situation of “beating others at will” is often controversial if it occurs in a relatively closed kindergarten.
